WHAT IS AN EXPUNGEMENT IN ARKANSAS?
In Arkansas, many individuals who have been arrested or convicted of a crime qualify to have their criminal records sealed. This process is also commonly referred to as expungement.
Sealing a criminal record does not mean that your records are destroyed or completely wiped clean. It does mean that the information about your arrest, charges, or conviction should be treated as confidential. After the record is sealed, the public should no longer able to see it, and you are legally permitted to deny that you committed the offense.
WHAT IS REQUIRED FOR AN EXPUNGEMENT IN ARKANSAS?
Unfortunately, not everyone is eligible to petition to have their criminal record sealed. Our legal team will determine if you are eligible to have your record sealed.
Felonies each require a careful look to see if you are eligible. However, most misdemeanor charges will be eligible to be sealed after the conditions of any sentence have been completed. Some misdemeanor offenses require a waiting period of five years.
Misdemeanor crimes that probably require the extended wait time include:
- Indecent exposure
- Fourth-degree sexual assault
- Battery in the third degree
- Class A negligent homicide
- Driving or boating while intoxicated
- Public sexual indecency
- Third-degree domestic battery
Seal Dismissed or Dropped Charges in AR
A conviction is not the only thing that can show up on a criminal record. Arrests and charges can be added to your criminal history even if the charges were later dismissed, or if your trial resulted in a not guilty.
The good news is, your arrest records are probably eligible for record sealing/expungement. You may be able to also request to seal your record if you were arrested for an offense, but the prosecution did not file charges within one year of the arrest.
